Transcription Studio Terms of Service
These terms sit under the FCT Technologies terms of service, which cover the FCT account and the systems every app shares.
These Terms of Service govern your use of Transcription Studio (the “App”), a native macOS and iOS application provided by FCT Technologies LLC (“FCT,” “we,” “us,” or “our”).
By using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Who provides Transcription Studio
Transcription Studio is provided by FCT Technologies LLC, an Illinois limited liability company.
If you need to contact us about these Terms, you can email:
FCT Technologies LLC
support@fct-technologies.com, and we respond within 5 business days
2. What the App does
Transcription Studio records or imports audio and turns it into a timestamped transcript that identifies who was speaking. Speech recognition and speaker separation run on your own device, on Apple silicon. No transcription service, cloud provider, or third-party API receives your audio.
The App can also extract highlights from a transcript, decisions, action items, events, people and places, using Apple’s on-device foundation models. That processing also happens on your device.
We may modify, suspend, or discontinue any part of the App at any time.
3. Accounts
The App requires an FCT account. You create or sign into one the first time you open the App, using Sign in with Apple, Sign in with Google, or an email address and password. There is no signed-out mode.
Your library, sessions, transcripts, highlights, speaker names and the recordings themselves, is stored in your FCT account and made available on your other devices signed into the same account. One FCT account works across every FCT app.
You are responsible for keeping your device and account credentials secure, and for activity that happens under your account.
4. Your content
You keep ownership of everything you record, import, or create in the App.
You grant FCT a limited right to process that content only as needed to operate, sync, secure, troubleshoot and support the App, as described in the Privacy Policy. That right ends when you delete the content.
You are responsible for having the right to record and transcribe what you capture. Recording conversations, calls and meetings is regulated, and the rules differ by jurisdiction: some require the consent of every participant. Obtaining any consent the law requires is your responsibility, not ours.
5. Acceptable use
You agree not to:
- record, import, or transcribe content you do not have the legal right to process;
- use the App for unlawful, harmful, abusive, deceptive, or infringing activity;
- attempt to reverse engineer, interfere with, or bypass the App’s security or access controls;
- use automated bulk extraction except through the App’s own export features;
- present a transcript as a verified or certified record where it is not.
6. Accuracy
Transcripts and speaker labels are produced by automated models and can be wrong. Speech recognition misreads words; diarization can merge or split speakers. FCT does not guarantee accuracy, and the App is not a certified transcription service.
You are responsible for reviewing a transcript before relying on it, and you should not rely on one unreviewed where accuracy matters: legal, medical, financial, employment, or evidentiary use included.
7. Intellectual property
The App, its software, design, and branding are owned by FCT or its licensors. These Terms grant you a limited, non-exclusive, non-transferable license to use the App for lawful personal or internal business use. No ownership rights transfer to you.
The App incorporates third-party open-source components under their own licenses, including WhisperKit for speech recognition, and NVIDIA’s Sortformer model and SpeakerKit for speaker diarization. Those licenses govern those components.
8. Availability
We use reasonable efforts to keep the App and its sync service working, but we do not guarantee uninterrupted access. Because transcription runs on your device, the App continues to transcribe when our sync service is unreachable; your library syncs when the connection returns.
9. Disclaimer of warranties
To the maximum extent permitted by applicable law, the App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy.
10. Limitation of liability
To the maximum extent permitted by applicable law, FCT Technologies LLC and its affiliates, owners, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption.
To the maximum extent permitted by applicable law, FCT’s total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid FCT for the App in the 12 months before the claim or (b) $100.
Some jurisdictions do not allow certain limits, so some limits may not apply to you.
11. Indemnification
If your use of the App violates law or these Terms, including recording someone without the consent the law requires, and that use results in a claim, demand, or proceeding against FCT, you agree to indemnify, defend, and hold FCT harmless from that claim, including reasonable attorneys’ fees.
12. Privacy
Your use of the App is also governed by the Transcription Studio Privacy Policy.
13. Termination
You may stop using the App at any time; deleting your account ends the account provisions. We may suspend or terminate access if needed to comply with law, protect the App, enforce these Terms, or discontinue the App.
Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
14. Changes to these Terms
We may update these Terms. If changes are material, we will provide reasonable notice through the App or this page. Continued use after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of Illinois, United States of America, without regard to conflict-of-law principles. Venue for disputes will be in state or federal courts located in Illinois, unless applicable consumer law gives you another non-waivable right.
