Villain Arc Terms of Service

These Terms of Service govern your use of the Villain Arc app and related public materials provided by FCT Technologies LLC.

By downloading, accessing, or using Villain Arc, you agree to these Terms.

1. Who provides Villain Arc

Villain Arc is provided by FCT Technologies LLC.

2. Eligibility and responsible use

You may use Villain Arc only in compliance with applicable law and these Terms. You are responsible for using the app in a safe and reasonable way and for making sure you have compatible Apple hardware, software, and services where required.

If you use Villain Arc on behalf of another person or organization, you represent that you have authority to do so.

3. Fitness and wellness disclaimer

Villain Arc is a fitness and wellness tool. It is not medical advice. It is not medical diagnosis. It is not medical treatment.

Villain Arc does not replace a physician, physical therapist, registered dietitian, or other qualified professional. You should use your own judgment and seek professional guidance when appropriate, especially if you have a medical condition, an injury, pain, dizziness, unusual symptoms, or any question about whether training activity is appropriate for you.

You use Villain Arc, its workout tracking, its suggestions, its goals, and its health related features at your own risk.

4. No guarantee of results

Villain Arc may present workout plans, exercise suggestions, goals, health related summaries, analytics, and historical trends. These features are informational tools only.

FCT Technologies LLC does not guarantee performance improvements, fitness outcomes, health outcomes, injury prevention, uninterrupted availability, or error free operation. Training results depend on many factors outside the app, including your health, technique, recovery, consistency, environment, and judgment.

5. Apple services

Villain Arc may rely on Apple platform services and features, including iCloud, CloudKit, Apple Health, HealthKit, notifications, and the App Store. Some features may depend on those services being available and properly configured.

Your use of those Apple services is also subject to Apple’s own terms and privacy practices.

6. Privacy

Your use of Villain Arc is also governed by the Villain Arc Privacy Policy. Please review that policy to understand how information is handled.

7. Acceptable use

You agree not to use Villain Arc in a way that violates law, interferes with the app or related services, misuses Apple integrations or system surfaces, attempts unauthorized reverse engineering except where prohibited restrictions are unenforceable, or uses the app in a fraudulent, abusive, or harmful way.

8. Intellectual property

Villain Arc, including its software, design, branding, text, graphics, and other app content, is owned by FCT Technologies LLC or its licensors and is protected by applicable intellectual property laws.

These Terms give you a limited, non exclusive, non transferable, revocable license to use Villain Arc for personal and lawful use in accordance with these Terms. No ownership rights are transferred to you.

9. Availability and changes

FCT Technologies LLC may update, modify, suspend, or discontinue part or all of Villain Arc at any time. We may also update these Terms from time to time. If we do, the updated Terms will apply when posted or otherwise made available. Your continued use of Villain Arc after updated Terms become effective means you accept the revised Terms.

10. Disclaimer of warranties

To the maximum extent permitted by applicable law, Villain Arc is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.

This includes implied warranties such as merchantability, fitness for a particular purpose, non infringement, availability, completeness, and accuracy. FCT Technologies LLC does not warrant that Villain Arc will always be secure, accurate, complete, available, or free from bugs or interruptions.

11. Limitation of liability

To the maximum extent permitted by applicable law, FCT Technologies LLC and its affiliates, owners, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, business opportunity, or health or fitness outcomes arising from or related to your use of Villain Arc.

To the maximum extent permitted by applicable law, the total liability of FCT Technologies LLC for claims arising out of or related to Villain Arc will not exceed the amount you paid, if any, to use the app during the twelve months before the claim arose.

Nothing in these Terms limits liability that cannot legally be limited.

12. Indemnity

You agree to indemnify and hold harmless FCT Technologies LLC and its affiliates, owners, employees, contractors, and licensors from claims, liabilities, damages, losses, and expenses arising out of or related to your use of Villain Arc, your violation of these Terms, your violation of law, or your misuse of workout, suggestion, or health related features.

13. Termination

FCT Technologies LLC may suspend or terminate access to Villain Arc if we believe these Terms have been violated or the app has been used in a way that could create harm, liability, or legal exposure.

You may stop using the app at any time.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnity, and governing law.

14. Governing law

These Terms are governed by the laws of the State of Illinois, United States of America, without regard to conflict of laws principles.
